Digital downloads are not eligible for return, cancellation or refund following purchase.

Printables

Designs are licensed for personal use only. Commercial use of any kind is strictly prohibited unless otherwise stated in the item description.

Permission is granted to print hard copies of the design as sold by Thomkat Illustrations on this site for personal use only. Any other use of the printable, including reproduction for purposes other than those permitted above, modification, distribution, republishing, transmission, display or performance is strictly prohibited.

By purchasing these digital illustrations, you agree to abide by the terms of use set out below.

Definitions

Licensee – individual or small business identified as the purchaser during the purchase process

Licensor – Thomkat Ltd, trading as Thomkat Illustrations

Commercial use – any use that involves the exchange of money or consideration, that promotes a small business, product or service, where financial gain or other consideration is directly or indirectly sought or results from the Licensee’s use of the digital illustrations.

Non-commercial use – any use for solely personal purposes, excluding any and all uses defined as commercial use above.

This agreement sets out the terms and conditions of the licensee’s non-exclusive and limited licence with respect to the digital illustrations purchased by the licensee.

Any use for commercial purposes must be significantly different than the original illustration(s); require time, effort, and skill to produce; and not derive its primary value from the illustration(s) itself.

Commercial and non-commercial use is permitted for:

One set of personal or small business social media accounts owned and managed by the Licensee
One personal or small business website owned and managed by the Licensee

Permitted uses:

End Products for non-commercial use

physical end products not for resale or wholesale, for example but not limited to; clothing, cards, invitations, stickers, mugs, stamps, candles, posters, signs, home decor, etc.
physical or digital end packaging products; for example but not limited to, labels, stickers, or containers, etc.
digital end products for non-commercial use such as static designs, static website elements
digital or print publications for example but not limited to; invitations, photo albums, and scrap books, e-books or e-publications, etc.

Digital Content for commercial and non-commercial use

as elements within a design or composition for social media content, for example but not limited to story highlights, static posts, video posts, etc
as elements within a design or composition for website content
as elements within digital or print publications where the publication is not for sale as a standalone product, for example but not limited to; slides or workbooks to accompany an online course, webinar or other presentation etc.

The illustrations cannot be used for:

digital or physical end products for sale
as standalone social media or website content
on demand applications, such as but not limited to print-on-demand services, create-on-demand, regardless of whether the end product is indented for sale
templates of any kind where the end user is able to extract the original illustration
digital development such as website software development, mobile app development, desktop application development and video game development
as part of a trademark, service mark, design mark, trade-name

The copyright of all elements of the clipart is retained by Thomkat Illustrations and the Licensee may not claim the Licensed Asset (or a modification thereof) as its own copyrighted work.
